Bangalore Metro Update: EoI invited for establishing KIOSKs at Namma Metro stations for promoting and selling products

Bangalore Metro Rail Corporation Ltd., (BMRCL) a Joint Venture of Government of Karnataka and Government of India, invites open Bid through National Competitive Bidding (Single Stage – Two Envelope System) from eligible, reputed and experienced Consultants (JV/Consortium Not Permitted) for Expression of Interest for establishing KIOSKs at Namma Metro stations for promoting/selling products.

General:

  • BMRCL invites expression of interest from the interested agencies/individuals/corporates for establishing “Kiosks” at Metro Stations.
  • Interested agencies may submit their proposals indicating the locations in the Metro Stations. The location will be allotted on a first come first serve basis.
  • BMRCL offers the location at a discounted rate. The agencies must be willing to take minimum of 5 kiosks with a maximum area of 150 sq. ft. at each location under the terms and conditions mentioned herein after. The interested agencies may submit their request in a prescribed format.

General Terms and Conditions:

  • Per Kiosk, the party shall deposit 10 months (for a tennure of 3 years) equivalent rent as interest free Security Deposit to BMRCL in the form of Bank Guarantee or DD or NEFT or RTGS.
  • The party shall pay the fixed monthly license fee within 10th of each month along with applicable GST. Every delayed license fee will attract 18% simple interest per annum.
  • In case, the party forecloses the contract/agreement, the security deposit available with BMRCL will be forfeited.
  • For each kiosk, BMRCL will provide up to 3 KW interrupted power supply. In each kiosk, a separate temporary electricity meter will be installed and as per the consumption, the party shall pay the electricity charges.
  • There will be a fit-out period (license free construction period) of 30 (thirty) days for setting up of the kiosk. This 30 (thirty) days fit-out period will be commenced from the date of issue of Notice to Proceed.
  • Damage to Premises: The Party accepts that any work carried out by the Party and/or its agencies at “Namma Metro”, shall not affect or damage the structure, facadets, flooring, cables. Or any part of “Namma Metro” within or outside.
  • The Party shall be liable for all damages to the rented space and, upon demand, shall reimburse to BMRCL for the cost of the repair of the rented space or any other damage elsewhere within the Station premises caused by or arising from the installation or removal of kiosk from the licensed space or from the removal of Party’s kiosk upon the expiration or earlier termination of this License Agreement.
  • Any damage, if caused, shall be the sole liability & responsibility of the Party and the decision of BMRCL in this regard shall be final and binding. BMRCL reserves the right to deduct repair costs from the security deposit. If the repair exceeds the deposit, the party has to make good the actual expenditure incurred for the damage caused within 7 days after receiving information from the licensee.
  • The Party will not make any permanent structure at the licensed premises and will use only temporary modular arrangements for the purpose required and agreed. The kiosks shall be kept open only during the commercial operation of the Metro Service.
  • The actual occupancy of the space taken by the Party is the essence of this application. If the Party does not occupy such space under the terms and conditions set forth herein under, BMRCL is authorized to occupy such space or allot the said space to any other applicant without releasing the Party from any liability hereunder. BMRCL reserves the right to relocate Exhibitors to space other than specified location. No inconvenience, damage / loss in any means shall be caused to any other occupier, commuter, staff of Namma Metro, by the Party or its representatives during the work and activity.
  • The Party shall not display anything, which shall be or is likely unfair, illegal, unlawful, immoral, or the like and shall comply with extant rules and regulations of relevant government agencies.
  • Statutory licenses: If there are any licenses, authorizations, or permits required by any statutory authorities for the type of activity to be carried on at or for the use of the licensed space, the Party shall be responsible for obtaining such. No unlawful activities shall be permitted in the use of the licensed space.
  • Hazardous Material: Licensee shall not keep, cause or permit any hazardous/prohibited material to be brought upon, stored, kept, used, or discharged on or about the Leased Premises.
  • In case required, BMRCL reserves the right to relocate the location of promotional activity to a mutually agreed location (BMRCL and Party). The Party shall not promote specific religious, political or social views in any way whatsoever Solicitation is prohibited.
  • Signage: All signage must be of professional quality and approved by BMRCL prior to the Commencement date. Banner and hand-written signage is not permitted. The BMRCL reserves the right to remove, alter or relocate signs at BMRCL’s sole discretion and without consequence from the Party or event participants. The party must ensure that the brand name of the outlet should display in Kannada language with equal or more prominence to English.
  • Obstruction of commuter movement The Party Shall ensure that there shall not be obstruction of commuter movement. Insurance: the party shall obtain adequate insurance coverage for the men and materials. Against theft, public liability, and BMRCL’s property.
  • Care and Removal of Kiosk and promotional items: The Party must, at its own expense, keep the Kiosk area clean. All promotional activity may continue up to the Metro Rail Service On the day of the termination of the license period, In the event the licensee fails to remove its kiosk after the termination, BMRCL reserves the right to remove the kiosk at Party’s expense.
