Objective:

  • The objective of the contract is the maintenance of DMRC structures to keep restore or improve facilities and services to current acceptable standards and sustain utilities and value of the facility by the contractor (including without limitation, the maintenance and removal of the Temporary Works) and the rectification of defects appearing in Permanent structures in the manner and to the standards and within the time stipulated by the Contract.
  • In full recognition of this objective, and with full acceptance of the obligations, liabilities and risks which may be involved, the Contractor shall undertake the execution of the Works.

General:

  • The maintenance of the Permanent Works shall be done in accordance with Employer’s Requirements and the other requirements of the Contract to keep buildings and services fully utilizable.
  • The Maintenance Works shall be executed to the highest standards available using proven up-to-date good Engineering practices.
  • The Specification shall in any case not specify standards which, in the Engineer’s opinion, are less than or inferior to those described in the Technical/Maintenance Specifications contained in the Tender Documents.

Scope of Works:

  • The contractor will execute the work i.e” Providing and Fixing/Replacing of RCC Trench Covers in the Viaduct of Line-3 & Line- 4 section.” Contractor shall prepare the drawing/work method/bar chart for the approval of the DMRC as per requirement.
  • The above-mentioned work shall be carried out with contractors own material & labour as per the specification & drawing.
  • The Brief scope of work is mentioned in DSR/BOQ and as per site requirement. The work under this contract shall consist of, but not limited to, all materials, labour, equipment’s, tools, plants and necessary machinery as required to completely execute following works in block hours/non block hours:
  • The work includes maintenance activities that may arise at stations buildings of Line-3 and 4 for emergency exit structure maintenance work shall be part of the main contract.
  • Other miscellaneous items and execution of work as per instruction of Engineer in charge. The contractor shall plan & execute the work in such a way that the work proceeds smoothly to the satisfaction of the engineer. Contractor shall arrange (at its own cost) the site visit of the Engineer or his representative to the site.
  • All the reinforced trench covers to be provided shall be factory made and the factory/ casting yard from where the trench cover shall be procured shall be approved from DMRC. Visit of Engineer/ Engineer’s representative shall be arranged by contractor at his own cost.
  • The sketches given in tender drawings are indicative & may be modified to suit the site conditions and nothing shall be paid extra on this account.
  • The Contractor shall attend regular coordination meetings convened by the employer/engineer for interface and adhere to the decisions taken in the meeting.
  • Access will be provided to the staff of the contractor appointed by the employer for carrying out their works and bringing materials and Equipment at site. However, the security of materials and Equipment brought at the site will be the responsibility of the contractor. Work will be executed in Non-revenue/OHE Block Hours at night and nothing shall be paid extra for this.
  • In case of major addition/alterations the drawings including details of structural drawings may be supplied by the agency.
  • The contractor shall plan & execute the work in such a way that the work proceeds smoothly to the satisfaction of the engineer.
  • The work shall be carried out with all safety precautions. The contractor shall ensure all his workers have Personal Protective Equipment (PPE‟s) at his cost (not to be charged to the worker) and ensure safety of site by providing Barricades for restricting movement of public to work area.
  • The barricade arrangement shall be approved by Engineer in charge keeping in view the overall circulating pattern of the staff/visitors Access will be provided to the staff of the contractor appointed by the employer for carrying out their works and bringing materials and Equipment at site.
  • However, the security of materials and Equipment brought at the site will be the responsibility of the contractor Defect liability period (DLP) shall be 12 months from the date of issue of completion certificate, for all the items supplied and works carried out.
  • Completion Time period is 36 months from the stipulated date of commencement of work. The material/RCC trench cover should be casted as per drawing provided by engineer in charge. Factory visits should be planned before procurement of material.

Interface Work:

  • In addition, the Contractor shall be required to accommodate requirements of miscellaneous works as per interfacing requirements.
  • The Contractor shall carry out necessary coordinations with Facility Manager, E&M Contractor and various system contractors pertaining to traction power supply, signalling, telecommunication, AFC etc.

Structures:

  • The maintenance of structures will have to be planned in such a manner that they do not obstruct or interfere with existing utilities.
  • Where work is required to be carried out at locations adjacent to such utilities suitable safety and protection arrangements will have to be ensured for which nothing extra will be payable. 
  • It should be ensured that no damage is caused to any such element and Engineer/ Employer shall be indemnified against such damage at no extra cost.

Use of the Site:

  • The Site or Contractor’s Equipment shall not be used by the Contractor for any purpose other than for carrying out the Works in the scope of this contract, except that, with the consent in writing of the Engineer, the Site or Contractor’s Equipment such as batching and mixing plants for concrete and bituminous materials may be used for the work in connection with other contracts under the Employer.

Barricades and Signboards:

  • The Contractor shall erect barricades as per requirement & wherever necessary around its areas of operations to prevent entry by unauthorised persons to his Works Areas.
  • No work shall be commenced in any Works Area until the Engineer has been satisfied that the barricades installed by the Contractor are sufficient to prevent, within reason, unauthorised entry.
  • Barricades shall be maintained in clean and good order by the Contractor until the completion of the Works.
  • All Barricades installed by the Contractor shall be removed by the Contractor upon the completion of the Works, unless otherwise directed by the Engineer.
  • Barricades can be reused after removal from one place to other locations/ sites provided they are in good condition and approved by the Engineer.
  • Damage/worn-out barricades shall be replaced by contractor within 24 hours. The Engineer’s decision regarding the need for replacement shall be final and binding and if no action is taken by the Contractor, the Engineer may get it repaired through another agency and the cost of any repairs will be deducted by the Engineer from any payment due to the Contractor.

Care of the Works:

  • Unless otherwise permitted by the Engineer all work shall be carried out in dry conditions.
  • The works, including materials for use in the works, shall be protected from damage due to water. Water on the Site and water entering the Site shall be promptly removed by temporary drainage or pumping systems or by other methods capable of keeping the Works free of water.
  • Silt and debris shall be removed by traps before the water is discharged and shall be disposed of at a location or locations to which the Engineer has given his consent.
  • The discharge points of the temporary systems shall be as per the consent of the Engineer. The Contractor shall make all arrangements with and obtain the necessary approval from the relevant authorities for discharging water to drains watercourses etc. The relevant work shall not be commenced until the approved arrangements for disposal of the water have been implemented.
  • The methods used for keeping the Works free of water shall be such that settlement of, or damage to, new and existing structures do not occur.
  • Measures shall be taken to prevent flotation of new and existing structures.

Eligibility:

  • The tenders for this contract will be considered only from those tenderers (proprietorship firms, partnership firms, companies, corporations, consortia or joint ventures) who meet requisite eligibility criteria prescribed in the sub-clauses of Clause 1.2 of NIT.
  • In the case of a JV or Consortium, all members of the Group shall be jointly and severally liable for the performance of the whole contract. Also, each member shall be individually responsible for its duties as specified in the MOU/JV agreement submitted by the bidder in terms of clause 1.2.1 vii (d).
  • Performance of each JV/Consortium partner shall also be judged on a quarterly basis. In case, the performance of the partner(s) is not found satisfactory, actions as deemed appropriate by the Employer may be taken including termination of contract or termination of any of JV/ Consortium member(s) from the contract i.e. Part Termination of the contract.
  • In case of part termination of contract, the Performance Security(ies) submitted by the member(s) for their portion of work in contract as per their share in JV/Consortium shall be forfeited and the scope of the work/duties assigned to the defaulting JV/Consortium member(s) as per the MOU/agreement submitted, may be terminated, however, same may be done by the Employer only if other member(s) of JV/Consortium are ready to complete the entire scope of work.
  • In such a case, remaining works pertaining to the scope of defaulting member of JV, may be completed by other member(s) of JV in the following manner:
  • On their own, if they have adequate technical competence to the satisfaction of Employer.
  • By subcontracting such scope of work of defaulting member(s) to technically competent Agency with the consent of Employer & without any financial implication to the Employer. In such cases, the limit of subcontracting the works up to 50% of total scope of work shall not apply.
  • By induction of new members having adequate technical competence and meeting the original tender eligibility conditions, acceptable to the Employer in JV/Consortium replacing the defaulting member(s) & without any financial implication to the Employer.
  • The new member(s) shall be jointly & severally liable for the performance of the whole contract and also shall submit the Performance Security from their bank account for an amount equivalent to the amount of forfeited amount of Performance security of the defaulting Member.

Work Experience:

  • The tenderers will be qualified only if they have successfully completed work(s), completion date(s) of which falling during the last five years ending on the last day of the month previous to the month of tender submission as given below.
    • At least one “similar work” of value of Rs.337.88 lakh or more, or
    • At least two “similar works” **each of value of Rs.211.18 lakh or more, or
    • At least three “similar works”**each of value of Rs.168.94 lakh or more
  • Similar works for this contract shall be “Any work consisting of any individual or a combination of the activities like: construction, maintenance, repairs, painting, retrofitting, of Building, and /or bridges or similar structures”.
  • If the activity of “painting” is a part of the whole work the value of the entire contract will be considered in evaluation of the work experience. If the work is largely for “Painting” such experience will not be considered.

Notes:

  • The tenderer shall submit details of works executed by them in the Proforma of Appendix-7 of FOT for the works to be considered for qualification of work experience criteria. Documentary proof such as completion certificates from clients clearly indicating the nature/scope of work, actual completion cost and actual date of completion for such work should be submitted.
  • The offers submitted without this documentary proof shall not be evaluated. In case the work is executed for a private client, copy of work order, bill of quantities, bill wise details of payment received certified by C.AT.D.S certificates for all payments received and copy of final/last bill paid by client shall also be submitted.
  • All the documents or certifications, which are provided by CA after 1st July, 2019, must contain UDIN thereon and the particulars of certifications must be the same as mentioned on document/certification and submitted to ICAI on its website.
  • Value of a successfully completed portion of similar work in any on-going composite work (work involving other than similar work also) up to the last day of the month previous to the month of tender submission will also be considered for qualification of work experience criteria subject to completion of the entire scope of similar work in a composite work.
  • Only work experience certificate having stamp of Name and Designation of officer along with the name of client shall be considered for evaluation. However, if any work experience certificate has been issued prior to 01.07.2019, the same shall be considered for evaluation even if it is not stamped.
  • For completed works, value of work done shall be updated to the last day of the month previous to the month of tender submission price level assuming 5% inflation for Indian Rupees every year and 2% for foreign currency portions per year. The exchange rate of foreign currency shall be applicable 28 days before the submission date of tender.
  • If the above work(s) (i.e. “Similar work” comprises other works, then the client’s certificate clearly indicating the amount of work done in respect of the “similar work” shall be furnished by the tenderer in support of work experience along-with their tender submissions.
  • Work experience of only substantial partners (partner with a share of 26% or more in the JV/ Consortium) shall be considered for evaluating the JV/ Consortium.
  • In case of joint venture/ Consortium, full value of the work, if done by the same joint venture shall be considered. However, if the qualifying work(s) were done by them in a JV/Consortium having different constituents or percentage participation, then the value of work as per their percentage participation in such JV/Consortium shall be considered.
  • After opening of financial bids, the work experience credentials (work experience certificate along with other documents if any) of L-1 bidder shall be sent for verification & certification to the concerned clients(s).
  • In case of any concealment or misrepresentation of facts, appropriate action(s) in accordance with tender conditions and “Suspension/Banning Policy, August 2019” of DMRC shall be taken. The copy of “Suspension/Banning Policy, August 2019” of DMRC can be downloaded from the tender section of DMRC website.
  • Where a work is undertaken by a group, only that portion of the contract which is undertaken by the concerned applicant/member should be indicated and the remaining done by the other members of the group be excluded. This is to be substantiated with documentary evidence.
