Scope of Work:

  • The scope of work in brief is given below, but the scope also includes all other requirements stipulated in various parts/volumes of the contract document including appendices and annexure:
  • Cleaning and preparation of the land ready for the installation of Height Gauge.
  • Providing Height Gauge as per drawings, specifications and as per the instructions of Engineer/Employer.
  • Design and execution of all temporary works necessary for providing Height Gauge shall be carried out by the Contractor at his own cost.
  • Contractor shall coordinate with all other contractors of Employer, who are working in the site and railway officials.
  • The Works as completed by the Contractor shall be wholly in accordance with the Contract and fit for the purposes for which they are intended, as defined in the Contract. The Works shall include any work which is necessary to satisfy the Employer’s Requirements, the Contractor’s Proposal and Schedules, or is implied by the Contract, or arises from any obligation of the Contractor and all works not mentioned in the Contract but which may be inferred to be necessary for stability, or completion, or the safe, reliable and efficient operation of the Works.
  • The Contractor shall design, if in the scope of work, manufacture, execute, install, complete, test (including Integrated Testing in case of rolling stock and signalling contracts) and commission, the Works, including providing Construction and/or Manufacture Documents, within the Time for Completion and shall remedy any defects within the Contract Period.
  • The Contractor shall provide all superintendence, labour, Plant, Materials, Contractor’s Equipment, Temporary Works and all other things, whether of a temporary or permanent nature, required in and for such design, works and remedying of defects.
  • Before commencing design, if in the scope of the Contract, the Contractor shall satisfy himself regarding the Employer’s Requirements (including design criteria and calculations, if any) and the items of reference mentioned in Sub-clause 4.8.
  • The Contractor shall give notice to the Engineer of any error, fault or other defect in the Employer’s Requirements or such items of reference. After receipt of such notice, the Engineer shall determine whether Clause 12 shall be applied, and shall notify the Contractor accordingly.
  • The Contractor shall take full responsibility for the adequacy, stability and safety of all Site operations, of all methods of construction, manufacture, and of all the Works, irrespective of any approval or consent by the Engineer.
  • The Contractor shall be deemed to have satisfied himself before submitting his Tender as to the correctness and sufficiency of his Tender to cover all his risks, liabilities and obligations set out in or implied by the Contract and all matters and things necessary for the proper design, manufacture, execution, installation, completion, testing, Integrated Testing whichever is in the scope of the Contract, commissioning of the Works and remedying of the Defects.

The Contractor acknowledges responsibility for ascertaining and securing at his own cost:

  • Conditions bearing upon the proper transportation, disposal, handling and storage of materials (including but not limited to hazardous toxic substances and excavated materials);
  • Availability of electricity, water and gas;
  • Availability of skilled manpower;
  • The character of equipment and facilities needed preliminary to and during the manufacture, installation, execution, testing, Integrated Testing, and commissioning of the Works and remedying of any defects;
  • The protection of the environment and adjacent structures which will be necessary preliminary to and during the manufacture, installaiton, execution, testing, Integrated Testing, and commissioning of the Works and remedying of any defects;
  • The location of and the authorisation required for and the means of diversion of any services and facilities required for the purposes of the Works.
  • The Contractor shall, whenever required by the Engineer, submit details of the arrangement and methods which the Contractor proposed to adopt for the execution of the Works. No alteration to these arrangements or methods shall be made without the approval of the Engineer.

Guarantees and Warranties:

  • Within 30 days of the date of Letter of Acceptance of the Tender, the Contractor shall submit to the Employer:
  • An Undertaking in the approved format from a Parent Company, the identity of which shall have been submitted in writing to the Employer prior to acceptance of the Tender and against which the Employer shall have raised no objection.
  • A written Guarantee in the approved format from a Parent Company, the identity of which shall have been submitted in writing to the Employer prior to acceptance of the Tender and against which the Employer shall have raised no objection. A warrant in the approved format from the Contractor.
  • In the event that the Contractor shall comprise two or more members, corporations acting in partnership, joint venture, consortium or otherwise each such member or corporation shall submit a Parent Company Undertaking and Guarantee. Notwithstanding any other provision of the Contract:
  • Submission by the Contractor of the requisite Performance security, Parent Company Undertakings and written Guarantees shall be condition precedent to the Contractor’s entitlement to any payment, under the Contract; and
  • Failure by the Contractor to provide a Performance Security or Parent Company Undertakings or Parent Company Guarantees shall entitle the Employer either to suspend the Works or to terminate the Contract forthwith by notice in writing to that effect, notwithstanding that the Contractor may have been permitted to proceed with the Works, and the Contractor shall not be entitled to any compensation whatsoever as a consequence of such suspension or termination.

Work Experience:

  • The tenderers will be qualified only if they have substantially completed work(s)**, completion date(s) of which falling during last seven years ending last day of the month previous to the month of tender submission as given below:
    • At least one “similar work” * of value of INR 6,49,745 or more, or
    • Two “similar works” *each of value of INR 4,33,163 or more, or
    • Three “similar works” *each of value of INR 3,24,872 or more.
  • The “Similar works” for this contract shall be “Any Civil Engineering work.”
  • Substantially completed means where 80% payment of the contract value has been received If the tenderer is a JV/Consortium having foreign partner(s) and above work(s) have been executed by the foreign partner of JV and the work(s) were done in the country of the foreign partner, then in addition to this the foreign partner must have executed works (which need not be similar in nature) of total put together of value INR 3,24,872 or more outside the country of the foreign partner.

Notes:

  • Work experience of only substantial partners (partner with a share of 26% or more in the JV / Consortium) shall be considered for evaluating the JV/Consortium.
  • The tenderer shall submit details of works executed by them in the Performa of Appendix-17 & 17A of FOT for the works to be considered for qualification of work experience criteria.
  • Documentary proof of completion certificates from clients clearly indicating the nature/scope of work, actual completion cost and actual date of completion for such work should be submitted.
  • The offers submitted without this documentary proof shall not be evaluated. In case the work is executed for a private client, a copy of work order, bill of quantities, bill wise details of payment received certified by C.A., T.D.S certificates for all payments received and a copy of the final/last bill paid by the client shall also be submitted.
  • Value of the substantially completed portion of any ongoing work up to the last day of the month previous to the month of tender submission will also be considered for qualification of work experience criteria.
  • For completed works, value of work done shall be updated to the last day of the month previous to the month of tender submission price level assuming 3% inflation for Indian Rupees every year. The exchange rate of foreign currency shall be applicable as on the date of contract award.
  • In case of Joint venture / consortium, full value of the work, if done by the same joint venture shall be considered. If the qualifying work(s) were done by them in a JV/consortium having different constituents, then the value of work as per their percentage participation in such JV/Consortium shall be considered.
  • If the above work(s) comprise(s) other works also, then details clearly indicating the amount of work done in respect of the “similar work” shall be furnished by the tenderer in support of work experience along-with their tender submissions.
  • Only work experience certificate having stamp of Name and Designation of officer along with the Name of the client shall be considered for evaluation. However, if any work experience certificate has been issued prior to 01.07.2019, the same shall be considered for evaluation even if it is not stamped.
  • In case of any concealment or misrepresentation of facts, appropriate action(s) in accordance with Tender Conditions and “Suspension/ Banning Policy, June 2020” of NHSRCL shall be taken.
