Scope of the Project:

  • Under this Agreement, the scope of the Project (the “Scope of the Project”) shall mean and include:
  • Construction of the Railway Project on the Site set forth in ScheduleA and as specified in Schedule-B together with provision of Project Facilities as specified in Schedule-C, and in conformity with the Specifications and Standards set forth in Schedule-D; with Contractor’s own Material Supplies including Turnout sleepers, Special sleepers (for SEJ/Guard Rails,/LXings etc), Points (switches) & Crossings, Glued Joints, H-beam/Composite sleepers over Girder Bridges, SEJs, Guard rails, Check Rails etc., all Signalling, Telecom and Electrification/Lighting materials as per laid down specifications.(Refer to Schedule – R for Employer’s Free Supply items);and
  • Only Rails shall be supplied by the Employer free of cost (For linking of track only) (Refer to Schedule – R for Employer’s Free Supply items); and
  • Performance and fulfilment of all other obligations of the Contractor in accordance with the provisions of this Agreement and matters incidental thereto or necessary for the performance of any or all of the obligations of the Contractor under this Agreement.
  • The project length will be 42.78 Km (Approx), Contractor has to work within defined construction area that is beyond Home signal of Junagadh towards Jetalsar Junction (-1.00 Km (Approx.)) to First Turnout connecting Junagadh-Visavadar line to Proposed Visavadar B.G. Yard towards Junagadh. (42.78 Km) Approx length 42.78 Km
  • Track work from beyond Outer most point of Junagadh Yard ( On Rajkot Side) (-1.00 KM) to first Turnout connecting Junagadh-Visavadar line to Proposed Visavadar B.G. Yard towards Junagadh. Approx length 42.78 Km. Total Length: 42.78 Km
  • In further details, the project length is considered for reference. However, work shall be carried out as per approved concept plan, and Junagadh yard remodelling will be done as per approved ESP and Signalling Plans.

Site:

  • The site of the Railway Project comprises the section connecting from Km -1.00 to Km 42.78 in the State of Gujarat in Bhavnagar Division of the Western Railway Zone. The site shall also include Junagadh. The work also includes yard remodelling of Junagadh station.
  • The Project alignment starts from Junagadh (JND) and ends at Visavadar (VSW) after connecting through Three stations. The total length of the existing route is 42.78 Km (approx.).
  • The Work Areas for the main Line (between Junagadh and Visavadar – 42.78km) which are identified in terms of Railway Km, as described in the following table, shall comprise an integral part of the scope of work.

Obligations of the Contractor:

  • Subject to and on the terms and conditions of this Agreement, the Contractor shall undertake the survey, investigation, design, engineering, procurement, and construction of the Railway Project and observe, fulfil, comply with and perform all its obligations set out in this Agreement or arising hereunder.
  • The Contractor shall comply with all Applicable Laws and Applicable Permits (including renewals as required) in the performance of its obligations under this Agreement.
  • Save and except as otherwise provided in this Agreement or Applicable Laws, as the case may be, the Contractor shall, in discharge of all its obligations under this Agreement, conform with and adhere to Good Industry Practice at all times.
  • The Contractor shall remedy any and all loss or damage to the Railway Project, occurring on or after the Appointed Date and until the date of Provisional Certificate, with respect to the Works completed prior to the issuance of the Provisional Certificate and/or Completion Certificate, with respect to the Works referred to in the Punch List, at its own cost, save and except to the extent that any such loss or damage shall have arisen from any default of the Employer or on account of a Force Majeure Event in which case the provisions of Clause 19 shall apply.
  • The Contractor shall remedy any and all loss or damage to the Railway Project during the Defects Liability Period at its own cost, to the extent that such loss or damage shall have arisen out of the reasons specified in Clause 15.3.
  • The Contractor shall, at its own cost and expense, in addition to and not in derogation of its obligations elsewhere set out in this Agreement:
  • Make, or cause to be made, necessary applications to the relevant Government Instrumentalities with such particulars and details as may be required for obtaining Applicable Permits set forth in Schedule-E and obtain and keep in force and effect such Applicable Permits in conformity with Applicable Laws;
  • Procure, as required, the appropriate proprietary rights, licences, agreements and permissions for Materials, methods, processes.

Signalling and telecommunication:

  • All signalling works including survey, design, supply, installation, testing and commissioning shall be executed in accordance with the provisions of the Indian Railway Signal Engineering Manual, Latest RDSO specifications and RDSO/Railway Board recommendations, Technical Advisory notes of RDSO and western Railway technical circulars & guidelines along with latest Western Railway work policy as on day of bidding. Current RDSO specifications are mentioned, however while procuring S&T items/materials, only the latest RDSO specifications will prevail.
  • Material shall be procured from RDSO approved vendors, wherever applicable and shall be inspected as per latest RDSO specifications. Drawing numbers mentioned here are current and may be updated. Latest Drawings/ Policies are required to be followed while execution of work.
  • Construction must also include verification and validation of system installed and independent certification for maintenance and operation system during its life cycle. All other associated materials and works for completion not limited to items described below and as required for execution of the signaling and telecom works to suit 25 KV has to be provided by the contractor.
  • As Per Railway Board Policy All New Works must be RE Fit and Contractor has to Procure only RE Fit S&T materials and Execute S&T Works strictly to suit 25KV RE.

Eligibility:

  • A Bidder may be a natural person, private entity, government-owned entity, or any combination of them with a formal intent to enter into an agreement or under an existing agreement in the form of a Joint Venture (JV). The bidder must ensure the following:

In case of Single Entity:

  • Submit Power of Attorney authorizing the signatory of the bid to commit the bidder.

In case of Joint Venture:

  • The number of partners in the JV shall not be more than that indicated in the Bid Data Sheet (BDS);
  • Submit MOU, as per form given in Appendix IA.
  • The JV shall nominate a Representative through Power of Attorney (Form given in Appendix IA) who shall have the authority to conduct all business for and on behalf of any and all the parties of the JV during the bidding process and, in the event the JV is awarded the Contract, during contract execution.
  • Submit Power of Attorney by individual partners to lead partners as per form given in Appendix IA.
  • In case a Joint Venture is the successful bidder, the Joint Venture Agreement should be entered by the Joint Venture partners. The duly signed Joint Venture Agreement should be submitted along with the Performance Security to the employer after notification of the award of contract within 28 days.
